Chinmoy Collection markets via its Internet website www.chinmoycollection.com (hereinafter referred to as the "Website") product collections marketed under the brand name "Chinmoy Collection" (hereinafter referred to as "Products" or “Product"). The personal and private user is hereinafter referred to as the "Client"
2 | SCOPE OF APPLICATION OF THE PRESENT GENERAL TERMS OF CONDITIONS
2.1 - The present General Terms and Conditions (hereinafter referred to as "GTC") apply to orders placed on the Website for strictly personal and private use for a delivery of the Products Worldwidely. The Client should read these Terms of Use carefully before using the website. If the Client does not agree to these Terms of Use, then the Client is not authorized to continue use of the website. If the Client does not agree to these Terms and Conditions, please do not use this website.
The Client agrees to the GTC by placing an order on the Website. The GTC can be printed and / or downloaded from the Website and available in English.
2.2 - Chinmoy Collection reserves the right to modify the GTC at any time, in which case the applicable version of said GTC shall be the one agreed upon by the Client when placing his/her order on the Website. The latest version of these Terms of Use will always be available on the website.
Based on Government Decree 45/2014 (II.26.) On the detailed rules of contracts between Client and businesses, the resulting contract is considered an off-premises contract in Hungarian, not in writing, which Chinmoy Collection does not register.
Chinmoy Collections reserves the right to make modifications at any time to this website, also without prior notification, including the modification, deletion and addition of content and services provided through the website. This is valid also to the form in which they are presented or their location in the website.
3 | PERSONAL DATA AND DESIGNATION OF THE CLIENT
3.1 - To access the online sale service on the Website, the Client has the possibility, but not the obligation, to open an online account.
Clients ordering products for personal use ( for non-commercial purposes) declare they are legally capable of entering into a contract. Accounts allow clients to place orders, track orders and deliveries, view past purchases, and edit personal data. It is a possibility, but not an obligation, to open an online account. ,
3.2 - To register an online account or receive commercial offers, the client completes the registration form with personal details including name, date of birth, phone number, address, email address, password, and delivery/billing addresses. By providing their email address, the client agrees to receive order-related information at their email address, and also to receive potential commercial offers from Chinmoy Collection.
3.3 - By opening an online account a security password is needed, that shall be strictly confidential. To access this online account, the Client must use the His / Her email address as a user name and the His /Her password.
After a the online form is finished, a confirmational email will be received to the given email address.
If the client forgets their password, they can reset it using their email address as the username.
3.4 – Personal data: Chinmoy Collection keeps the personal data collected confidential and uses it in accordance with the (personal) data protection regulations.
With the prior client's agreement, Chinmoy Collection will communicate the personal data to its partners in charge of the processing of the orders placed online, of the delivery of the Products and of the after-sale service.
The Client can choose to receive commercial offers from Chinmoy Collection, companies of the same group and / or commercial partners by filling the online form, when placing an order and / or opening an online account on the Website.
The Client can exercise at any time his/her right of access to the personal data (at My account on the Website), and can delete, change or correct it.
The client can object to the use or processing of their data for a valid reason. To do so, they can contact Chinmoy Collection in writing and mention their email address used as the username. They can send an email request to contact@chinmoycollection.com for a request.
If Chinmoy Collection or its assets would be sold, Client's information would be part of the transfer of assets.
4 | TERMS FOR PLACING AN ORDER
4.1 - Chinmoy Collection won't be able to warrant a perfect similarity with the Product(s) selected for purchase (like colours and details) due to handmade production.
All Products offered for sale (as long as they are available online and within the limits of available stock) on the Website have a photography and accurate information of the Product.
The Product in the quantity chosen is added to the shopping cart by clicking on the link "Add to shopping cart”. At any time, the Client can modify, validate or delete the Shopping cart's content.
4.2 - The following information are available in the "Shopping cart”: A picture and number of each Product selected, the title and key information of the Product (type and / or colour), the unit price and all tax included, subtotal price per Product, and a total price all tax included, excluding packaging and delivery costs and customs.
The Client is asked to check the list of Products to modify or accept it by clicking on the link "Checkout".
4.3 - Placing the order starts after accepting the content of the "Shopping cart”. The ordering can happen without opening an online account, and also by signing in: opening an online account on his/her first online order. Or by logging into the account: typing his/her email address as a user name and his/her password if he/she has opened an account before.
After filling in the delivery and billing addresses, the Client is asked to read the GTC and accept it by checking the box "I agree with the General Terms and Conditions for online sale”. If this box is not checked, than the Client cannot get access to the next step, which is the payment step.
Before paying, details of the order are one last time submitted to the Client.
4.4 - The accepted order can be payed with the Client’s credit card (Visa, MasterCard, American Express);
4.5 - Only after confirmation by the Bank, shall the order be placed and effective.
Before sending the confirmation order, Chinmoy Collection shall retain the right to refuse the order for just cause including when the selected article is no longer available for sale or if Chinmoy Collection is in dispute with the Client regarding payment of an order placed previously.
Chinmoy Collection confirms each order to the Client’s email with the order reference and date, delivery and billing addresses, total price all taxes included, including packaging and delivery costs, paid by the Client.
4.6 - Chinmoy Collection shall keep the written proof of the sales contract entered into with the Client for a period of time of 5 years starting on the delivery of the Products
Client can ask for a copy of said contract by writing, to the customers' relations service at the postal address mentioned at Article 1 of the GTC. However, Chinmoy Collection strongly recommends to the Client to keep copies of its order and more generally information related to the purchase.
4.7 - The order will not be considered valid until full payment has been received by Chinmoy Collections, and shipping of the products will not occur until payment is complete and effective.
4.8 - Chinmoy Collection verifies each order placed on the Website, and may ask the Client for any necessary documents to carry on the order. Such control aims at protecting Chinmoy Collection from abusive practices set up by fraudsters.
5 | PRICE
5.1 - The prices are mentioned on the product page, for each item with all taxes included, excluding packaging and delivery costs and custom tariffs.
The packaging and delivery costs are indicated to the Client for approval before the order is completed. Based on the location, (in or outside EU) the cost may differ due to customs duties and taxes may be applied.
5.2 - Chinmoy Collection reserves the right to modify the price of the Products at any time. The price accepted by the Client when validating his/her order is firm and definitive, the price quoted at the time of ordering shall prevail, however, in the event of accidental typing or system error, Chinmoy collection reserves the right to cancel the contract or apply the correct price.
6 | PAYMENT
6.1 - The Client pays in Euros with a credit card ( Visa®, MasterCard®, American Express® ) by transmitting the 15 or 16-digit number of his/her credit card, its expiry date and the security number indicated on the back of the card.
Accepted forms of payment are and can be made through Apple pay and PayPal as well.
The Client certifies that he/she is not prohibited from using a credit card for payment of his/her order and that this mean of payment grants Chinmoy Collection access to the sum necessary for the payment of the order.
6.2 - Transactions made on the Website are secured, and also the personal data. The payment is encrypted via SSL (Secure Socket Layer) encryption process. Data can neither be detected, nor intercepted nor used by third parties. Payment information shall be kept only by the bank that proceeded to the transaction. To validate the transaction, the Bank may ask for the Client’s personal data for identification.
If the transaction could not be executed and the Client payment account could not be debited, the sale would be immediately resolved and the order of the said Products would be canceled.
It is advised to keep the bank’s validation receipt of the transaction and more generally the information related to the purchase.
7 | DELIVERY
7.1 - The purchased items will be shipped by our contracted international partners, GLS and DHL to the delivery address given by the Client. In order to do so, the Client fills in the fields of the Chinmoy Collection online form on the website.
7.2 - The Client shall be advised of the shipping of the Products ordered by email, by the shipping companies. Should the Client be absent at the time of delivery, the shipping company shall send an email, SMS or calling card to the Client with the address of a drop-off location where the Client can get the Products.
7.3 - The delivery is deemed effective via the shipping company when the Client (or His/Her relative or caretaker ) has signed the delivery receipt, for the ordered item(s).
The Client is responsible for verifying or to refuse the Products delivered, whether if it appears to have been opened or if it bears signs of damage. Please contact customer service to start the withdrawal process, listed in Artical 10.
7.4 - Although Chinmoy Collection makes constant efforts for proper delivery time, it remains exposed to risks due to the delivery of parcels. The delivery time is up to 30 days from the date of order confirmation by the Client. Exceptions to this rule are pre-order sales and individual orders, where the expected delivery date specified by the seller is the relevant date.
If a non-compliance with the delivery deadline is noticeable, not attributable to a case of force majeure or a default of payment, Client shall be entitled:
7.5 - To cancel the order by email, via mentioning the references of the order. In this case, Chinmoy Collection will refund the Client the amount, all taxes included, of his/her order within 30 days of receiving the request for cancellation of the order.
8 | AVAILABILITY OF THE PRODUCTS
8.1 - The stocks displayed on the website are accurate, but due to the fact that several orders can be placed simultaneously, a mistake can occur in the processing or a Product in store can appear to have sustained damage. In this case, Chinmoy Collection shall send an email so the Client shall make a choice to wait, change or to cancel the order.
8.2 - When several Products have been ordered by the Client, and one or more Products in the order are not available in stock, then the order may be delivered partially. In this case, Chinmoy Collection will send an e-mail to the Client with a proposal.
8.3 - If the Client refuses or does not answer within 7 days, the order shall be canceled and Chinmoy Collection shall refund the Client with the total price of the Product initially ordered including its packaging and delivery costs.
9 | CONFORMITY OF THE PRODUCTS
9.1 - Chinmoy Collection strives to represent Products in online photographs as accurately as possible. However, limitations of digital photography may result in minimal differences due to handmade production.
9.2 - The terms and conditions for the return of the Products to Chinmoy Collection are provided for at Article 10.2 and Article 10.3 of the GTC.9.3 - The provisions of the present Article apply without prejudice to the provisions of Article 10 of GTC relating to the right of withdrawal of the Client.
10 | RIGHT OF WITHDRAWAL AND RETURN
10.1 - The Client has a right of withdrawal, to cancel his/her order and to return the Products ordered to Chinmoy Collection within 14 days starting on the day of delivery.
10.2 - Before returning Products within 14 days of delivery, the Client must inform customer service of their intent to withdraw. The Client should then return the Products to the postal address provided using the return coupon. The Client is solely responsible for the cost and risk of the return. Customs duties and taxes may apply to clients outside the European Union. Products must be returned in their original packaging and perfect condition. Incomplete or damaged returns will not be accepted or refunded."

10.3 - If the Products have been returned to Chinmoy Collection ( within 14 days upon exercise of the right of withdrawal) in an accepted original packaging and perfect condition, than the refund should be made to the Client.
10.4 - Such right of withdrawal does not apply to bespoke Products that have been customized on demand of the Client, for instance with the engraving of a name.
11 | GUARANTEE
11.1 - The seller guarantees that the product delivered to the Client conforms to the terms of the contract and is free from any lack of conformity at the time of delivery. The product should meet the typical purposes and expectations associated with such a product, as well as any specific requirements agreed upon by both parties. The seller is liable for any lack of conformity, and the Client is entitled to legal remedies within two years after delivery.
The seller is also responsible for any hidden defects that render the product unfit for its intended use or significantly impair its use. Within the time limit for appeals.
11.2 - The process starts with the Client sending a claim regarding the guarantee to the customer service of Chinmoy Collection, attached with a documentary and supporting evidence of the purchase. After this Chinmoy Collection shall confirm the implementation of the guarantee rules, or not and the replacement or refund will be proposed, based on the decision.
12 | INTELLECTUAL PROPERTY
12.1 – All the content of the Website, be it visual, graphical or sound, or the mark(s) and all other marks of Chinmoy Collection, whether or not composed of the words “Chinmoy Collection", as well as all intellectual property rights which may be attached to the products (Such as images, photographs, including any person represented in the photographs, illustrations, icons, texts, video clips, music, written and other materials), whether registered or unregistered, (the "Intellectual Property Rights") are and will remain the exclusive property of Chinmoy Collection.
Chinmoy Collection Material may not be communicated, displayed on any other platform, in a networked computer environment or on any other digital platform for any purpose whatsoever. It is not authorized to distribute, modify, sell, reproduce, communicate, display, publicly perform, report or otherwise prepare derivative or second hand works based on or use any Chinmoy Collection Material in any way for any public or commercial purposes. In the event of breach of any of these Terms of Use, any copies made of Chinmoy Collection Material must be immediately destroyed and the permission to use Chinmoy Collection Material will automatically terminate. 14 | RULE OF EVIDENCE
14.1 - The Client expressly accepts and acknowledges that messages sent by e-mail, Log files hosted on the servers of Chinmoy Collection or its technical service providers, statistical data generated and communicated by Chinmoy Collection, accessible electronically shall have the same evidential value as hard copies, letters.
If you transmit any unsolicited communication or material to Chinmoy Collection via their websites, social media, email or any other means, including but not limited to data, questions, comments, suggestions, etc., it will not be treated as confidential or proprietary information. 15 | LIABILITY AND DISPUTE
15.1 - Chinmoy Collection shall not be held liable for complete or partial breach of contract in case of force majeure, wrong of the Client, payment incident, or in case of unpredictable and insurmountable act of a third person.
Chinmoy Collection cannot be held liable for any potential damage that can occur when browsing the Internet such as, especially, a connection failure, the loss of data, access by a third party to the data on the computer of the Client, or risks of viruses or unwanted software installing.
15.2 - In case of breach of the contract by the Client under the provisions of the GTC, such as the transmission to Chinmoy Collection of false identification information, the use of invalid means of payment or illegal use of a third party's means of payment, Chinmoy Collection reserves the right to delete the online account of the Client and to cancel any pending order without prejudice to any claim for damages.
Chinmoy Collection also reserves the right to refuse any order from a Client with whom such breaches of contract would have occurred.
15.3 - In case of any conflicts or disputes arising between the user and the website, the applicable law for resolving such issues is the Hungarian law. The Hungarian law shall govern the interpretation of the General Terms and Conditions and any disputes arising from the use of the website. The Client is also entitled to have access to a mediator. In such case, the Client shall follow the procedure in force:
